What does the NZa do with your data?

There has been a lot of attention in the media for a scheme within the Care Performance Model. This regulation obliges all mental healthcare institutions to provide data about clients to the Dutch Healthcare Authority (NZa). On this page you can read what happens to your data.

Submitting data to NZa

The Dutch Data Protection Authority (DPA) has ruled positively on this obligation. Arkin submitted data to the NZa before 1 September 2023.

Objection

Clients could personally object to the sharing of certain data until 15 August 2023 by completing this privacy statement and taking it with them to the practitioner.

We asked clients who wanted to make use of this option to submit a completed privacy statement to the practitioner before 15 August 2023. The practitioner made sure that the statement was included in the medical file.

Conditions

The NZa has stated that they will never receive data that can be traced directly back to individual clients. In addition, the general information that the NZa receives is never linked to files that can still be traced back to individual persons.

The AP also set other strict conditions. For example, the NZa may only request data for the period of one year (i.e. 1 July 2022 to 1 July 2023).

How do I know if my statement has been registered correctly?

All privacy statements are  recorded   in the client file on client.No treatment-related information is  sent, but the type of care demand used is included.

What is provided with a privacy statement?

If a client has signed a privacy statement, we still have to provide data. However, this submission does not contain any treatment-related information. We then indicate that there is an active privacy statement and whether the dynamic or full care demand typology has been used. In the case of genergetic basic mental health care (gb-ggz), the gb-ggz profile is also sent. Gb-ggz is an extended version of what used to be the domain of the primary care psychologist.

Can data (with evidence) still be destroyed?

If Arkin receives a request from a client afterwards, Arkin will inform the NZa about this.

What will be done with the data at NZa if I only sign the privacy statement now?

Since the NZa cannot view the data at the individual level, it cannot make subsequent adjustments with regard to the care demand typology after delivery.

If I sign the privacy statement now, can I still be assured that the data has not been provided, or is it already too late?

The delivery has already taken place, the privacy statement could be completed until 15 August. This deadline was necessary to be able to submit on time (no later than 1 September 2023).

Was all data sent at once?

The delivery was made in one go. All data, as prescribed by the NZa, has been included. See the NZa leaflet for this.

Will the HONOS data indeed be provided to the NZa as of 1 January 2023, as previously announced?

In this submission, data on all clients for whom care demand typing was carried out between 1 July 2022 and 1 July 2023 was provided to the NZa.
